Judge John Kastrenakes, of the 15th circuit court of Florida, sentenced the man from West Palm Beach to 10 days behind bars, followed by a year on probation and 150 hours of community service, after he failed to show up for jury duty on time in August, WPTV reported.
Somerville was also sentenced to write an apology letter and pay fees of $233 after Kastrenakes told the court that the 21-year-old oversleeping delayed the trial by 45 minutes.
But on Friday the circuit court judge reduced Somerville’s sentence terms, CNN reported, adding that new conditions will see the young man serve three months of probation and only 30 hours of community service. He will also have to give a 10-minute talk on jury duty every week.
The Associated Press reported on Saturday that the circuit court judge could even drop Somerville’s contempt of court conviction if his probation conditions are met.
Judge Kastrenakes’ decision to reduce Somerville’s probation and community service came after the young man served 10 days behind bars.
At his appeal hearing on Friday, family and friends noted that Somerville assisted with the care of his grandfather and volunteered in the community, according to CNN.
“It hurts, but it’s a lesson learned. It could have been worse. He could have given me 365 days in jail,” Somerville told WPTV ahead of his appeal hearing last Friday.
Recounting what he told the judge at his initial trial for contempt of court, the 21-year-old said: “I just said: ‘Sir, honestly I overslept, and I didn’t understand the seriousness of this.’ He asked me if I had a criminal record. I said, ‘Sir, I’ve never been arrested.’”
The judge’s decision to reduce the terms of Somerville’s probation and community service on Friday came after backlash against his sentence on social media.
Kristen Clarke, the president and executive director of the National Lawyers’ Committee for Civil Rights Under Law, tweeted: “This is NOT a productive way to encourage people to respect civic service.”
CNN Host S.E. Cupp also linked to a piece on the sentencing and gave the judge’s decision a thumbs down while the City of Detroit’s Director of Arts & Culture Rochelle Riley said: “This is ridiculous and is not an incentive to not miss jury duty. It should be an incentive to remove this judge from the bench.”
A Change.org petition calling for Judge Kastrenakes to be punished for the “overkill” sentencing of Somerville has received 4,107 signatures of a 5,000 target at the time of writing.
